On 8 June 2026 a US district court vacated the policy used to collect it, and on 12 June the judge temporarily paused that order. The appeals court refused the government&#8217;s request for a stay on 24 July, and USCIS stopped collecting the payment while the appeal continues. On 18 September the US President extended the proclamation itself to 21 September 2027. Nobody official has said how the extension and the ruling interact. Plan for both outcomes, and put effort into what you control: the onsite-offshore mix, India-side capacity and state incentives.<\/p>\n<\/blockquote>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">The US President has <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/09\/restriction-on-entry-of-certain-nonimmigrant-workers-faad\/\" target=\"_blank\" rel=\"noopener\">extended the $100,000 requirement to September 2027<\/a>. A court has blocked the policy used to collect it, and US Citizenship and Immigration Services (USCIS) has <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/h-1b-faq\" target=\"_blank\" rel=\"noopener\">stopped collecting the payment<\/a> while the appeal continues. Read only the first and you would freeze new petitions. Read only the second and you would assume the problem had gone away. Both readings are unsafe.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">At the time of writing, the H-1B fee impact on Indian IT is a planning problem more than a cost line. The legal sequence below is as precise as the public record allows; the rest of the article covers what Indian IT services firms and global capability centres (GCCs) control. None of it is legal advice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The H-1B fee in court, date by date<\/h2>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Most of these steps changed whether the payment was being collected. Nobody official has said whether the last one did.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>September 2025.<\/strong> A presidential proclamation imposed a $100,000 payment on new H-1B petitions.<\/li>\n\n\n\n<li><strong>8 June 2026.<\/strong> In a case brought by 20 US states, <em>State of California v. Mullin<\/em>, the US District Court for the District of Massachusetts vacated the policy implementing the proclamation, nationwide.<\/li>\n\n\n\n<li><strong>12 June 2026.<\/strong> The judge <a href=\"https:\/\/www.fragomen.com\/insights\/united-states-district-court-temporarily-stays-order-vacating-dollar100000-h-1b-fee.html\" target=\"_blank\" rel=\"noopener\">temporarily paused his own order<\/a> while the government asked the appeals court for a stay, so the fee could again be collected in that period.<\/li>\n\n\n\n<li><strong>24 July 2026.<\/strong> The US Court of Appeals for the First Circuit denied the government&#8217;s request for a stay. In the words of <a href=\"https:\/\/www.ca1.uscourts.gov\/sites\/ca1\/files\/opnfiles\/26-1699O-01A.pdf\" target=\"_blank\" rel=\"noopener\">the court&#8217;s order<\/a>: &#8220;We deny the motion.&#8221; USCIS then stopped collecting the payment while the appeal continues.<\/li>\n\n\n\n<li><strong>18 September 2026.<\/strong> The US President signed <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/09\/restriction-on-entry-of-certain-nonimmigrant-workers-faad\/\" target=\"_blank\" rel=\"noopener\">a proclamation extending the September 2025 proclamation<\/a> &#8220;until 12:00 a.m. eastern daylight time on September 21, 2027&#8221;. It keeps the $100,000 requirement and does not mention the litigation.<\/li>\n<\/ol>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">USCIS has put its position on the record. Its <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/h-1b-faq\" target=\"_blank\" rel=\"noopener\">H-1B FAQ<\/a> says the Department of Homeland Security (DHS) &#8220;strongly disagrees&#8221; with the ruling &#8220;but will comply with the court&#8217;s order&#8221;. Then comes the sentence planners should keep in view: &#8220;If this order is later lifted, DHS still plans to collect the payment.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why the extension does not settle the question<\/h2>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">The two tracks concern different documents. The court vacated the policy implementing the proclamation. The 18 September proclamation extends the original, keeps the $100,000 requirement and does not mention the litigation. On its face, neither answers the other.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">As of 20 September 2026, USCIS had not said how the extension affects the court ruling, and the appeal is still pending. That leaves two live cases. If the order is later lifted, DHS has said it still plans to collect. If the order stands, collection stays stopped unless USCIS says the extension changes that, and so far it has not. The public record gives no basis for putting odds on either.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">What the extension does settle is a date on paper: 21 September 2027. That rules out freezing every new petition as though the payment were certain, and filing freely as though it had gone for good.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">If collection resumes<\/h3>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Each new H-1B petition then carries a $100,000 payment on top of the usual costs. Roles that genuinely need someone in the client&#8217;s building can still justify it; habitual ones mostly cannot.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">If the block holds<\/h3>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">USCIS is not collecting the payment while the appeal continues. Treat that as provisional, since DHS has said it still plans to collect if the order is later lifted. Whether a petition filed in this period could be affected by a later ruling is a question for immigration counsel, not a planning spreadsheet.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Moves that hold up either way<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A petition inventory.<\/strong> List every new H-1B petition planned before 21 September 2027, with the role, the client and the reason the work must be done in the US.<\/li>\n\n\n\n<li><strong>A priced contingency.<\/strong> Show the $100,000 as a separate, named line in any proposal that depends on new petitions, so a court decision moves one line rather than the whole margin.<\/li>\n\n\n\n<li><strong>A contract read.<\/strong> Ask your legal team which client contracts say who bears a change in immigration costs, and which say nothing.<\/li>\n\n\n\n<li><strong>A named owner.<\/strong> One person tracks the appeal and the USCIS FAQ, with an agreed trigger for reopening the plan.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">The onsite-offshore mix is the lever you hold<\/h2>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Courts and proclamations sit outside any delivery head&#8217;s control; the staffing model does not. Sort current and planned onsite roles into three groups. The first is work that physically has to happen in the US, such as equipment in a client facility or roles a contract requires to be local. The second is onsite by habit, where the real need is overlap with the client&#8217;s working day and someone senior in the room when things go wrong. The third is work where a local US hire may now be the simpler route.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Only the first group clearly justifies a new petition if collection resumes. The second is where Indian delivery organisations have the most room: overlap can be covered by teams working shifted hours in Bengaluru, Pune or Noida, and escalations by a smaller onsite lead backed by a larger team in India. None of this is new thinking, but getting the mix wrong now carries a price, even while nobody is collecting it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why India-side delivery looks stronger this year<\/h2>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">The case for more India-side work does not rest on the fee. The <a href=\"https:\/\/media.zinnov.com\/wp-content\/uploads\/2026\/05\/zinnov-nasscom-india-gcc-landscape-2026-report.pdf\" target=\"_blank\" rel=\"noopener\">Zinnov-nasscom India GCC report for 2026<\/a> counts 2,117 GCCs in India employing 2.36 million people, about 23.6 lakh, with a value of $98.4 billion. And they are still hiring: <a href=\"https:\/\/www.naukri.com\/blog\/tag\/naukri-jobspeak\/\" target=\"_blank\" rel=\"noopener\">Naukri JobSpeak for August 2026<\/a>, published on 7 September, recorded hiring by global capability centres up 10% year on year.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Neither figure shows the H-1B payment caused anything. They show scale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Budget 2026-27 changed<\/h3>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Budget 2026-27, as set out by <a href=\"https:\/\/www.pib.gov.in\/PressReleseDetailm.aspx?PRID=2227953\" target=\"_blank\" rel=\"noopener\">PIB on 14 February 2026<\/a>, proposed a tax holiday until 2047 for eligible foreign cloud providers that use India-based data centres for global operations. It raised the safe-harbour threshold for IT services from \u20b9300 crore to \u20b92,000 crore, at a common 15.5% margin. Resident data-centre entities get a separate safe-harbour margin of 15%.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">For a GCC that bills its parent for IT services, the threshold change is the one to read closely: a limit more than six times higher brings much larger units within the safe-harbour route. Confirm eligibility with your tax advisers before building a plan on it.<\/p>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">The data-centre measures also bear on where a GCC&#8217;s workloads and data sit; our <a href=\"https:\/\/www.wininfosoft.com\/insights\/sovereign-ai-indian-enterprises-2026\/\">piece on sovereign AI for Indian enterprises<\/a> covers the residency side.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">State GCC policies, and Uttar Pradesh in detail<\/h2>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Several states publish GCC policies with explicit aims. The figures differ in kind as well as size, and the largest GCC and job numbers come only from a draft.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.cbre.co.in\/insights\/articles\/karnataka-gcc-policy-2024-29-pioneering-growth-through-innovation-and-regional-development\" target=\"_blank\" rel=\"noopener\">Karnataka GCC Policy 2024-29<\/a>, announced on 19 November 2024, targets 500 new GCCs, 3.5 lakh jobs and $50 billion in output by 2029.<\/li>\n\n\n\n<li><a href=\"https:\/\/industry.maharashtra.gov.in\/sites\/default\/files\/2025-09\/gcc-policy-paraesa-naota-english.pdf\" target=\"_blank\" rel=\"noopener\">Maharashtra GCC Policy<\/a>, notified on 3 November 2025, looks to about 400 new GCCs, about 4 lakh jobs and \u20b950,600 crore of investment by 2030.<\/li>\n\n\n\n<li><a href=\"https:\/\/dst.gujarat.gov.in\/Home\/GujaratGlobalCapabilityCenter\" target=\"_blank\" rel=\"noopener\">Gujarat GCC Policy 2025-30<\/a> looks to at least 250 new GCCs, over \u20b910,000 crore of investment and more than 50,000 jobs.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Uttar Pradesh<\/h3>\n\n\n\n<p style=\"text-align:justify;text-justify:inter-word text-align: justify; text-justify: inter-word;\" class=\"has-text-align-justify wp-block-paragraph\">Uttar Pradesh GCC Policy 2024 took effect on 7 May 2025 and runs for five years, alongside the state&#8217;s <a href=\"https:\/\/invest.up.gov.in\/wp-content\/uploads\/2026\/03\/GCC-SOP_140326.pdf\" target=\"_blank\" rel=\"noopener\">GCC Rules 2025<\/a>.
